Late on Monday, June 8, a 28-year-old male motorist lost control of his 2006 Honda on Florida Boulevard in Palm Beach Gardens. The preliminary police investigation suggested that when he over-corrected, the vehicle went into a spin. It then allegedly struck an unoccupied, parked 2007 Dodge pickup truck.
Speed of 90 MPH Alleged
Minutes earlier, observers saw the truck travelling in excess of 90 mph on Military Trail, according to the Palm Beach Gardens police.
The man died at the scene of the crash. His 18-year-old female passenger required transport to St. Mary’s Medical Center. She is in critical condition.
Significant Criminal Record
A review of public documents by the Palm Beach Post revealed that the man had a felony conviction, a license suspension and multiple DUI arrests on his record. A judge suspended his driver's license for five years in 2013. The felony conviction dated back to 2007, when he pleaded guilty to grand theft. The man had also received multiple citations for speeding. An August 2014 DUI arrest led to a guilty plea and a jail sentence.
Although the investigation into this accident has not concluded, Florida state law allows a victim of negligent conduct to seek compensation in the civil courts. When negligence is reasonably asserted, it is possible to pursue monetary damages for unpaid medical expenses, pain-and-suffering and lost wages.
