Injury Attorney in Martin County Discusses Arrest For Alleged Fourth DUI

An arrest affidavit details the circumstances of an alleged hit-and-run DUI accident involving a 49-year-old Lake Worth man. Greenacres police initially responded to the crash near Lake Worth Road and Jackson Avenue.

Deputies Arrive at the Scene

Palm Beach County sheriff's deputies also arrived at the scene at approximately 10:40 p.m. on Saturday, May 16. At the time, they found a Chevrolet Colorado pickup truck parked on the opposite side of the street. The affidavit alleges that the pickup truck earlier struck a vehicle in the intersection.

Alleged Attempt to Flee

Deputies state that the man refused to open the locked doors of the truck. He allegedly attempted to drive away, but a deputy smashed the driver's window and grabbed him. It also alleges that the driver found it difficult to exit the vehicle due to alleged impairment due to alcohol. A deputy assisted him so that he would not fall. He allegedly refused to submit to sobriety tests.

Multiple Charges

Authorities charged the driver with multiple offenses, including driving under the influence, leaving the scene of an accident and operating a motor vehicle following a license revocation. State motor vehicle records reveal that the accused has three previous DUI convictions, and that the license revocation occurred in 2009, according to the Sun Sentinel.

He was still in custody at Palm Beach County Jail as of Monday, May 18, in lieu of posting $20,000 bond.

Although the investigation into this particular alleged DUI is in its preliminary stages, driving while intoxicated constitutes negligent conduct in certain cases. When such negligence is reasonably asserted, injured victims have a right to seek compensation in Florida's civil court system. In such cases, it is possible to seek monetary damages for medical bills, lost wages and pain-and-suffering.
